As Quilty-Dunn et al. observe, the language-of-thought hypothesis (LoTH) has fallen out of favor in philosophy. I will support the arguments made for its rehabilitation by Quilty-Dunn et al. by reviewing old, but still potent arguments for LoTH, and briefly criticizing recent proposed alternatives to LoT, such as Frances Egan's deflationism and Eric Schwitzgebel's dispositionalism, revealing inadequacies in such antirepresentational, antisyntactic theories.

The second issue is the definition of the U.S. Constitution as a mixed and not as a democratic constitution, with regard to the influences of Plato, Aristotle, Cicero and Polybius to the Drafters of the first modern constitutional text; stability and equilibrium took preference over democracy in (...) a wide sense. The first segment starts with a definition of two dimensions of the concept of rule of law; related to the notion of sovereignty and as a concept to control arbitrariness on the part of the ruler. The segment proceeds to give a historical account of the notion and the different stages of its epistemological configuration, from the ancient Greek notion of Eunomia and its incompatibility with the popular rule to the current notion, where the rule of law has become fused (...) with democracy and human rights. The first segment also focuses on the relation between the concept of the rule of law and other principles, such as proportionality, neutrality, and effectiveness. The second segment of the paper analyses the phenomenon of juridification of the rule of law in international treaties and domestic constitutions. It pays particular attention to the role that constitutional accommodation plays in the process of rationalization of the rule of law as a prerequisite to its idealization and mystification. It analyses the reason why this principle is an essential feature of the constitutionalism despite the inner plurality of legal systems. The next aspect, analysed in the third segment of this paper, is the messianic use of the concept of the rule of law. The paper performs a critical definition of messianic, covering a theological perspective and the different theories and concepts that go hand in hand with the idea of the Messiah, such as the “coming”, prophetical and apocalyptical messianism, the phenomena of eschatology, expiation and redemption pictured in Judaism. The segment also covers the secular transplantation of the messianic thought. The last segment is a conclusion returning to the themes identified in the paper and summarises how the messianic thought is applied in the realm of the rule of law. (shrink)

En este artículo se propone una interpretación no paradójica de la defensa que hiciera Hobbes del realismo científico de corte materialista. Se trata de explicar cómo este autor pudo defender la verdad del materialismo y, a la vez, negar que ello pudiera ser demostrado metafísicamente. La clave de su posición depende del uso metafórico del concepto de 'imitación' y del tratamiento del poder infinito e irresistible de dios como su atributo filosóficamente relevante. Así, la intención de Hobbes consistiría en decir (...) que la explicación, que no demostración, de la verdad del materialismo depende de la paridad y continuidad ontológica entre el mundo y el ser humano, tal y como éstas son explicadas por la ciencia empírica. En este sentido el proyecto de Hobbes, bien distinto al de Descartes, sería un intento de naturalizar la epistemología que, no obstante, es consciente de los límites metafísicos que afectan a las propuestas naturalizadoras de la filosofía. Este artículo se ocupa del problema de cuál pueda ser la naturaleza de la creencia y cuál la mejor explicación de su normatividad. Se analizan diversas teorías que desarrollan el modelo ¿estado más contenido¿, y se presenta como alternativa una concepción de filiación wittgensteiniana que entiende la creencia como acción simbólica y expresiva.

In this article we consider certain elements of the normative theory of Jürgen Habermas in the light of the proposals of Bruce Ackerman, with a view to strengthening a concept of deliberative democracy applied to the legitimation of juridical rules. We do not construct a hierarchy of the two positions, but seek to bring together certain elements to achieve a common project. As the starting point for examining the work of the two authors, we take the scheme proposed by Habermas (...) in Faktizität und Geltung. In this connection, through the work of Ackerman, we intend to fill in some of the gaps that Habermas appears to have left in the theory of radical democracy applied to the law. The work of Ackerman can make a significant contribution to deliberative democracy, to the discourse principle that Habermas defines, and to the contractualist theories from a liberal perspective. The study of these contributions makes possible a critical judgment that enables the legitimation of juridical rules carried out by Habermas to acquire greater practicity. In examining the epistemological status of juridical science and law, we attempt to determine the weight and the performance of normative democracy. In Tarr's view, it is a matter for philosophers to examine direct democracy and its desirability. (shrink)

Depuis la Grèce, en dépit des rêves d'une langue bien faite, les philosophes s'expriment dans des langues qui sont le partage de peuples différents. Or, peut-on inscrire le discours de l'universel dans le champ limité d'une langue particulière? Le français fait sa joie des analyses sèches, comme l'on parle d'une pointe sèche qui grave le cuivre nu. Celui qui saurait le conduire vers la synthèse, pourtant, aurait reconnu, selon le mot de von Humboldt, " l'énigme de cette langue ". Le (...) colloque de Nice, " Philosopher en français ", a tenté d'approcher une telle énigme. Trente-deux chercheurs internationaux ont croisé leurs exposés selon quatre thèmes : la philosophie française au XXe siècle ; la philosophie française et les courants internationaux ; l'histoire française de la philosophie ; le philosophe français et le style. Tous mettent l'accent sur l'approche " à la française ", comme disait Montaigne, des grandes questions théoriques et cherchent à définir ce qu'il en est du style français en philosophie. J.-F. M. Comment faut-il entendre la nécessité de ce " dépassement de la métaphysique "? Heidegger a répondu à ces questions en mentionnant, de manière explicite, le " tournant " (Kehre) propre de sa pensée, lequel permet moins d'effectuer le " dépassement " (Überwindung) que l' "appropriation " (Verwindung) de la métaphysique. Après cet épisode du " tournant " (...) que l'on peut faire remonter à 1930, Heidegger se dé-tournera de la métaphysique pour se consacrer à la pure pensée de l'être, dans laquelle la poésie, celle de Hölderlin en particulier, jouera désormais un rôle déterminant. Le poète précède toujours le penseur au cœur de cette forêt profonde qu'est l'Être. Pour Heidegger comme pour Dante, l'homme est un poème qui s'achève sous le regard scintillant d'une étoile. " Le nihilisme est devant la porte : d'où nous vient ce plus inquiétant de tous les hôtes? ", demande Nietzsche dans un fragment posthume. L'hôte est ici celui qui vient chez nous et non celui qui octroie l'hospitalité. Le nihilisme est donc cette figure étrange qui vient nous saisir dans notre maison et faire de nous, en dépit de notre résistance, des nihilistes. Mais alors, si " la catastrophe nihiliste " dont parle Nietzsche s'abat sur nous et nous pétrifie (...) sur notre propre seuil, comment devons-nous entendre la dénonciation nietzschéenne du nihilisme et sa tentative héroïque de le surmonter? Les auteurs réunis dans ce volume tentent d'éclairer le sens de la direction à prendre en ces temps obscurs où, toujours selon Nietzsche, nous ne savons plus où aller, où venir parce que nous avons perdu le sens de la terre. This book is a unique exploration of the idea of the "second person" in human interaction, the idea that face-to-face interactions involve a distinctive form of reciprocal mental state attributions that mediates their dynamical unfolding. In this paper a non-paradoxical interpretation of Hobbes’s defence of scientific realism of materialistic type is proposed. It attempts to explain how this author was able to defend the truth of materialism and at the same time to deny that it could be demonstrated in a metaphysical way. The key to his position depends on the metaphorical use of the concept of ‘imitation’ and the treatment of the infinite and irresistible power as the philosophically relevant attribute of God. So Hobbes’s (...) intention would consist of saying that the explanation, but not the demonstration, of the truth of materialism depends on the ontological parity and continuity between the world and the human being, in the way in which they are explained by empirical science. In this sense Hobbes’s project, very different to Descartes’s one, would be an attempt to naturalise the epistemology that yet is conscious of the metaphysical limits affecting the naturalistic proposals of philosophy. A key aim in biology and psychology is to identify fundamental principles underpinning the behavior of animals, including humans. Analyses of human language and the behavior of a range of non-human animal species have provided evidence for a common pattern underlying diverse behavioral phenomena: Words follow Zipf's law of brevity (the tendency of more frequently used words to be shorter), and conformity to this general pattern has been seen in the behavior of a number of other animals. It has been (...) argued that the presence of this law is a sign of efficient coding in the information theoretic sense. However, no strong direct connection has been demonstrated between the law and compression, the information theoretic principle of minimizing the expected length of a code. Here, we show that minimizing the expected code length implies that the length of a word cannot increase as its frequency increases. Furthermore, we show that the mean code length or duration is significantly small in human language, and also in the behavior of other species in all cases where agreement with the law of brevity has been found. We argue that compression is a general principle of animal behavior that reflects selection for efficiency of coding. (shrink)

In a series of influential articles, Rae Langton has argued that Austinian speech-act theory can illuminate the way in which pornography contributes to the subordination of women. I will argue that Langton’s application of Austin is incorrect. In earlier work, I have argued against Langton’s view on the grounds that being subordinated is not the sort of condition that can be brought about through an illocutionary act. In this paper, however, I will set aside that objection and focus instead on (...) Langton’s claims about the type of illocutionary act pornography might be. I will argue, first, that Langton cannot say what she wants to say about the content of pornography and still have it that pornography is a verdictive or exercitive speech act, in Austin’s sense. Verdictive and exercitive speech acts do not, and cannot describe the states of affairs they bring about. Second, I will argue that pornography does not in any case satisfy the conditions necessary for a speech act to be verdictive or exercitive. Specifically, there do not exist accepted background conventions that would give the pornographer authority to render verdicts or to take executive action. This objection to Langton’s view has been made before; I’ll show that her response to the objection betrays a confusion of authority with power. (shrink)

In order to understand what we are talking about when we talk about joint attention, I will scrutinize how the mainstream view that builds on representational and intentionalist theories of mind is constituted. My aim is to show that much of the theory of joint attention is quite narrowly constructed and comes with tacit disciplinary biases that exclude much of what is existentially important in our practices of sharing our perceptions and guiding others to attend to the world in novel (...) ways. By using the frameworks of classical phenomenology and enactivist theories of mind, I aim to show how we, in our interactions, share our perceptions even with beings that are distinctly different from us. And, that this _difference_ in our personal worldview, our cognitive capacities, and our sensory modalities should be seen as a constitutive aspect of our practices of shared attention. I will articulate attention as a revelatory practice that aids us in discovering a shared world through the plurality, rather than similarity, of our perceptual actions. Attention is, in this sense, not solely driven by subjective intentions; it is also formed and co-constituted by my being addressed by the other. (shrink)

Qu'est-ce que la fameuse caverne de Platon si ce n'est la plus grande chambre noire que l'on ait jamais réalisée? Reprenant cette intuition de Paul Valéry, Jean-François Mattéi procède à une relecture magistrale des grands dialogues de Platon, de La République au Timée, pour y découvrir la matrice de notre monde, un monde envahi par les images et les simulacres. Du cinéma aux jeux vidéo en passant par Internet, le cyberespace et les téléphones portables, nouvelles "cavernes personnelles ", les images (...) ont en effet pris le pouvoir. Censées initialement représenter le réel, elles se sont mises à le simuler, à le dupliquer, voire à l'absorber pour faire surgir une nouvelle dimension, celle du virtuel. Matrix, Avatar, World of Warcraft, Toy Story, la 3D, sont le vecteur de cette révolution. Pour la plupart des philosophes, la victoire des simulacres constitue un renversement sans précédent du rapport entre image et réalité, institué il a 2500 ans par Platon. Les images ne seraient plus le miroir d'une réalité intelligible qui leur confère consistance, mais de purs simulacres sans aucun rapport avec le réel. En croisant la lecture minutieuse de Platon avec une plongée passionnante dans les processus les plus contemporains de modélisation des images, cet essai démontre qu'il n'en est rien. Loin d'être autonomes, les phénomènes de simulation proviennent de procédés rationnels qui projettent leur intelligibilité dans le sensible. Et ces procédés artificiels redoublent l'opération première, advenue dans la nuit des temps, au cours de laquelle le monde fut structuré grâce à des modèles intelligibles qui se sont inscrits en lui. Le vingtième siècle aura été le siècle de la démesure. La démesure de la politique avec des guerres mondiales, des déportations et des camps d'extermination, qui a culminé avec deux bombes atomiques larguées sur des populations civiles. La démesure de l'homme, ensuite, puisque ces crimes ont été commis au nom d'idéologies abstraites qui, pour sauver l'humanité, ont sacrifié sans remords les hommes réels. La démesure du monde, enfin, avec une science prométhéenne qui a tenté de percer les secrets de l'univers, (...) une technique déchaînée qui a cherché à asservir la nature et une économie mondialisée dont les échanges ont imposé le prix des choses au détriment de la dignité des hommes. Nietzsche avait clairement établi le diagnostic : "La mesure nous est étrangère, reconnaissons-le; notre démangeaison, c'est justement la démangeaison de l'infini, de l'immense. " Le sens de la démesure semble être une fatalité, aussi n'est-il pas étonnant que, déjà chez les Grecs, dans le mythe, la tragédie, la physique, l'éthique ou la politique, il se situe au coeur de la réflexion. Au travers de la tentation de la raison d'abolir toute limite, de remettre en cause la finitude humaine, la démesure témoigne du tragique de notre condition. Les Grecs, et c'est l'enseignement de ce livre, se sont attachés à la comprendre pour la convertir en cette mesure qui permet de redonner un sens à notre existence. (shrink)

Nous vivons une période étrange, probablement même périlleuse à bien des égards. Les avancées de la science, de la médecine et des technologies sont telles qu'elles posent désormais la question de l'avenir de notre commune humanité. Mon corps est-il ma personne ou est-il une chose? S'agit-il simplement d'un ensemble de pièces que l'on peut remplacer, ou d'une enveloppe que l'on pourrait changer? Notre destin est-il, tout entier, inscrit dans nos gènes? Avec le développement des techniques de procréation médicalement assistée, l'enfant (...) demeure-t-il un sujet de droit ou devient-il un objet auquel on aurait droit? L'aventure humaine est-elle réellement menacée par le posthumanisme? Que penser enfin des promesses d'un homme manipulé et amélioré par le transhumanisme, grâce aux nanotechnologies, aux biotechnologies, à l'informatique et aux sciences cognitives... Jean-François Mattei nous propose un retour à une culture du doute, nécessaire pour armer notre pensée face aux défis à venir. Nous invitant à une réflexion éthique, philosophique et politique, il nous amène à nous demander si, modifiant notre humanité, nous pourrions néanmoins rester humains... (shrink)

Abordamos aquí los diferentes comentarios críticos sobre las ideas centrales del libro Social Cognition and the Second Person in Human Interaction. En primer lugar, aclaramos algunos aspectos de la propuesta: la relación entre las interacciones de la segunda persona y las expresiones corporales de los estados psicológicos atribuidos y el papel que éstas tienen en la adquisición de los conceptos psicológicos más básicos. A continuación precisamos el sentido en que las atribuciones de la segunda persona son prácticas y transparentes. Por (...) último, destacamos el papel ubicuo de la normatividad en las interacciones de la segunda persona, enfatizando las asimetrías que existen en estas relaciones y mostramos por qué sostenemos que no hay interacciones desprovistas de normatividad a las que ésta posteriormente se les añade.
